Stationary Sources

The District has authority to inspect facilities operating under a Permit to Operate. Inspections may be planned or unplanned and range from simple drive-bys to detailed site audits. The permit contains conditions of operation that are designed to minimize air pollutant emissions and prevent public nuisance. Permit conditions may regulate hours of operation, production rates, chemical usage parameters, visible emissions opacity, and emission control devices. Site inspections are designed to monitor compliance with permit conditions and recordkeeping requirements. Violations of the Permit to Operate may result in civil and/or criminal penalties.

Open Burning

The District issues Conditional Open Burn Permits for agricultural and special vegetative-waste burning, and regulates residential yard-waste open burning, including burn barrels and burn piles. Burn permits and burn regulations stipulate legal burn materials, burn methodology, conditions required before burning, burn days, and burn hours. The District has the authority to inspect and regulate open burning. Violations of open burn regulations may result in civil and/or criminal penalties.

Complaints

Public nuisance complaints may be lodged by members of the public against any agency, business or resident violating District regulations including smoke, odor, and dust nuisance emissions. The District responds to public nuisance complaints under our regulatory authority. Violations of public nuisance regulations may result in civil and/or criminal penalties.

Enforcement Actions

Violators may be served a warning,  a Notice to Comply, or a Notice of Violation and may be subject to a Mutual Settlement Agreement, small claims, or civil or criminal suit.
